Ley de Sociedades de Inversión
Artículo 88.
Serán sancionadas con prisión de cinco a quince años las personas que realicen actos de los reservados por este ordenamiento legal a las sociedades de inversión, operadoras de sociedades de inversión o distribuidoras de acciones de sociedades de inversión, sin que para ello se cuente con la autorización correspondiente en los términos de la presente Ley.Igual pena será aplicable a las personas que constituyan o actúen en el desempeño de fideicomisos, mandatos o comisiones, cuyo objeto sea invertir o administrar cualquier clase de valores, ofreciendo a persona indeterminada participar de las ganancias o pérdidas producto de la adquisición y, en su caso, enajenación de los valores objeto de inversión o administración. Se considerará que se está en presencia de persona indeterminada, cuando al constituir el fideicomiso o celebrar el mandato o comisión, las personas que participen no se encuentren plenamente identificadas al momento de celebrar el contrato respectivo y, en su caso, se permita la adhesión de terceros una vez constituidos o celebrados.
La sanción a que se refiere el párrafo anterior, no será aplicable a las personas que de conformidad con las leyes aplicables, actúen en el desempeño de fideicomisos, mandatos o comisiones que tengan por objeto la emisión, adquisición, enajenación o administración de valores, títulos y documentos, ajustándose para ello a los términos y condiciones que al efecto establezcan las leyes.
