Código de Instituciones y Procedimientos Electorales
Artículo 43.
EL RÉGIMEN DE FINANCIAMIENTO DE LOS PARTIDOS POLÍTICOS SE SUJETARÁ A LAS SIGUIENTES REGLAS:
(PÁRRAFO REFORMADO. P.O. 2 DE AGOSTO DEL 2002)
I. TENDRÁ LAS SIGUIENTES MODALIDADES:
A) FINANCIAMIENTO PÚBLICO, QUE PREVALECERÁ SOBRE LOS OTROS TIPOS DE FINANCIAMIENTO; Y
B) FINANCIAMIENTO QUE NO PROVENGA DEL ERARIO PÚBLICO, CONSISTENTE EN:
1) FINANCIAMIENTO POR LA MILITANCIA;
2) FINANCIAMIENTO DE SIMPATIZANTES;
3) AUTOFINANCIAMIENTO; Y
4) FINANCIAMIENTO POR RENDIMIENTOS FINANCIEROS, FONDOS Y FIDEICOMISOS.
II. LOS PARTIDOS POLÍTICOS NO PODRÁN RECIBIR, POR SÍ O POR INTERPÓSITA PERSONA Y BAJO NINGUNA CIRCUNSTANCIA, SALVO EL FINANCIAMIENTO ESTABLECIDO EN EL PRESENTE CÓDIGO Y EN LA LEY DE LA MATERIA QUE RIJA EN EL ORDEN FEDERAL, APORTACIONES O DONATIVOS, EN DINERO O EN ESPECIE, PROVENIENTES DE:
A) LOS PODERES EJECUTIVO, LEGISLATIVO Y JUDICIAL DE LA FEDERACIÓN Y DE LOS ESTADOS, Y LOS AYUNTAMIENTOS, SALVO LOS ESTABLECIDOS EN LA LEY DE LA MATERIA;
B) LAS DEPENDENCIAS, ENTIDADES U ORGANISMOS DE LA ADMINISTRACIÓN PÚBLICA FEDERAL, ESTATAL O MUNICIPAL, Y LOS ÓRGANOS DE GOBIERNO DEL DISTRITO FEDERAL;
C) LOS PARTIDOS POLÍTICOS, PERSONAS FÍSICAS O MORALES EXTRANJERAS;
D) LOS ORGANISMOS INTERNACIONALES DE CUALQUIER NATURALEZA; Y
E) LOS MINISTROS DE CULTO, ASOCIACIONES, IGLESIAS O AGRUPACIONES DE CUALQUIER RELIGIÓN O SECTA.
III. LOS PARTIDOS POLÍTICOS NO PODRÁN SER DUEÑOS O SOCIOS DE EMPRESAS DE CARÁCTER MERCANTIL, NI SOLICITAR CRÉDITOS PROVENIENTES DE LA BANCA DE DESARROLLO PARA EL FINANCIAMIENTO DE SUS ACTIVIDADES. TAMPOCO PODRÁN RECIBIR APORTACIONES DE PERSONAS NO IDENTIFICADAS, CON EXCEPCIÓN DE LAS OBTENIDAS MEDIANTE COLECTAS REALIZADAS EN MÍTINES O EN LA VÍA PÚBLICA. LAS APORTACIONES QUE LAS PERSONAS FÍSICAS O MORALES HAGAN A LOS PARTIDOS POLÍTICOS NO SON DEDUCIBLES DE IMPUESTOS.
IV. LOS PARTIDOS POLÍTICOS DEBERÁN TENER UN ÓRGANO INTERNO ENCARGADO DE LA ADMINISTRACIÓN DE TODOS SUS RECURSOS, ASÍ COMO DE LA PRESENTACIÓN DE LOS INFORMES A QUE SE REFIERE EL ARTÍCULO 44 DE ESTE MISMO ORDENAMIENTO. DICHO ÓRGANO SE CONSTITUIRÁ EN LOS TÉRMINOS Y CON LAS MODALIDADES Y CARACTERÍSTICAS QUE CADA PARTIDO LIBREMENTE DETERMINE.
V. LAS QUEJAS SOBRE EL ORIGEN Y USO DE LOS RECURSOS DERIVADOS DEL FINANCIAMIENTO DE LOS PARTIDOS POLÍTICOS, DEBERÁN SER PRESENTADAS ANTE EL SECRETARIO DEL CONSEJO GENERAL DEL INSTITUTO ELECTORAL DEL ESTADO DE GUANAJUATO, PARA QUE LES DÉ EL TRÁMITE CONDUCENTE.
