Artículo 238.
LA DEMANDA DEBERÁ CONTENER:
I.- EL NOMBRE DEL ACTOR Y DOMICILIO QUE SEÑALE PARA OÍR Y RECIBIR NOTIFICACIONES, DEBIÉNDOSE DESIGNAR CASA UBICADA EN LA POBLACIÓN DONDE TENGA ASIENTO EL TRIBUNAL FISCAL ANTE EL QUE SE PROMUEVA Y LOS DEL TERCERO INTERESADO CUANDO LO HAYA;
II.- EL NOMBRE Y DOMICILIO DEL DEMANDADO;
III.- LA RESOLUCIÓN O PROCEDIMIENTO QUE SE IMPUGNE Y LA AUTORIDAD DEMANDADA;
IV.- LOS HECHOS Y FUNDAMENTOS DE DERECHO EN QUE SE APOYE LA RECLAMACIÓN;
V.- LOS CONCEPTOS DE NULIDAD QUE SE HAGAN VALER EN CONTRA DE RESOLUCIONES Y PROCEDIMIENTOS IMPUGNADOS; Y
VI.- LAS PRUEBAS QUE EL ACTOR SE PROPONGA RENDIR, LAS CUALES DEBERÁ RELACIONAR CON CADA UNO DE LOS HECHOS. CUANDO OFREZCA PERICIAL O TESTIMONIAL, EL ACTOR DEBERÁ INDICAR LOS NOMBRES DE LOS PERITOS O TESTIGOS Y ACOMPAÑAR LOS INTERROGATIVOS QUE DEBAN CONTESTAR. SIN EL CUMPLIMIENTO DE ÉSTOS REQUISITOS, NO SE TENDRÁN POR OFRECIDAS.
SE PRESENTARÁ CON LA DEMANDA EL DOCUMENTO O DOCUMENTOS QUE EL ACTOR OFREZCA COMO PRUEBAS Y ESTÉ EN POSIBILIDADES DE OBTENER O INDICAR EL ARCHIVO O LUGAR EN QUE SE ENCUENTREN PARA QUE A SU COSTA SE MANDE EXPEDIR COPIA DE ELLOS O SE REQUIERA SU REVISIÓN, CUANDO ÉSTA SEA LEGALMENTE POSIBLE; PARA ESTE EFECTO DEBERÁ IDENTIFICAR CON TODA PRECISIÓN DICHOS DOCUMENTOS. SE ENTIENDE QUE EL ACTOR TIENE A SU DISPOSICIÓN LOS DOCUMENTOS, SIEMPRE QUE LEGALMENTE PUEDA OBTENER COPIA AUTORIZADA DE LOS ORIGINALES.
EL ACTOR PRESENTARÁ COPIA DE LA DEMANDA PARA CADA UNA DE LAS PARTES Y COPIA DE LOS DOCUMENTOS QUE PRESENTE PARA LA SECRETARÍA DE FINANZAS Y ADMINISTRACIÓN Y PARA LA AUTORIDAD EMISORA DE LA RESOLUCIÓN O ACTO IMPUGNADO, CUANDO NO DEPENDA DE LA SECRETARÍA MENCIONADA.
