Artículo 2138.
En el supuesto previsto en el artículo anterior, son aplicables las siguientes disposiciones:
I. El vendedor, sea o no de buena fe, deberá indemnizar al comprador de los daños y perjuicios que resulten de la nulidad del contrato;
II. Si el comprador sabía que el bien era ajeno, no podrá exigir la restitución del precio ni la indemnización de los daños y perjuicios que se le hubieren ocasionado;
III. El vendedor de mala fe, después que haya entregado el bien, no puede demandar la nulidad de la venta ni la restitución del bien vendido;
IV. La nulidad de la venta de un bien ajeno no perjudica los derechos que la ley concede al segundo o ulterior adquirente de buena fe;
V. Si el vendedor adquiere por cualquier título legítimo la propiedad del bien vendido, antes de sufrir evicción el comprador, la venta producirá todos sus efectos;
VI. La venta del bien ajeno surtirá todos sus efectos, si el propietario de la misma ratifica el contrato en forma expresa
