Artículo 383. SANCIONES Y FIGURAS TÍPICAS DE MANIPULACIÓN GENETICA Y DE INSEMINACION ARTIFICIAL INDEBIDA
Se aplicará prisión de dos a seis años y multa, a quien:
I. MODIFICACIÓN ARTIFICIAL DE GENOMA HUMANO. Modifique artificialmente el genoma de una célula reproductora humana.
II. USO DE GENOMA HUMANO MODIFICADO ARTIFICIALMENTE. Utilice con propósito de fecundación células reproductoras humanas con un genoma modificado artificialmente.
III. ASOCIAR EMBRIONES CON GENOMAS HUMANO Y OTRO DIFERENTE. Asocie en una unidad celular embriones con genomas diferentes, cuando por lo menos uno de ellos sea humano.
IV. FECUNDACIÓN DE UN ÓVULO HUMANO CON ESPERMA DE UN ANIMAL, O DE UN ÓVULO ANIMAL CON EL ESPERMA DE UN SER HUMANO. Produzca un embrión diferenciado mediante la fecundación de un óvulo humano con esperma de un animal, o de un óvulo animal con el esperma de un ser humano.
V. IMPLANTE DE EMBRIÓN MANIPULADO. Implante uno de los embriones a que se refieren las fracciones anteriores a una mujer o a un animal.
VI. IMPLANTE DE UN EMBRIÓN HUMANO A UN ANIMAL. Implante un embrión humano a un animal.
VII. CLONACIÓN CON CÉLULAS HUMANAS. Realice una hibridación en la que por lo menos una de las células sea humana; o una clonación con célula humana; salvo que sólo se trate de obtener en forma aislada tejido con claro propósito de rehabilitación terapéutica.
VIII. USO DE CÉLULAS HUMANAS CON FINES DE REPRODUCCIÓN CON UN GENOMA MODIFICADO ARTIFICIALMENTE. Use células humanas con fines de reproducción con un genoma modificado artificialmente.
Las sanciones mínimas y máximas del primer párrafo de este artículo, se aumentarán en un tercio: A quien sin consentimiento de una mujer mayor de dieciocho años de edad; con o sin el consentimiento de una menor de esa edad o incapaz; practique en ella inseminación artificial. Si como resultado de la conducta se produce embarazo, se aplicará prisión de cuatro a diez años y multa.
Se aumentarán en una mitad más los mínimos y máximos de las sanciones: Si en el implante o la inseminación que prevén estas fracciones se utiliza violencia contra la mujer.
Además de las penas previstas en los párrafos anteriores, se impondrá la suspensión para ejercer la profesión o, en caso de servidores públicos, la inhabilitación para el desempeño del empleo, cargo o comisión públicos, por un tiempo igual al de la pena de prisión impuesta, así como la destitución.
