Artículo 45.
El referéndum es un instrumento democrático de consulta popular, por el cual, mediante el voto mayoritario de los electores, en los términos que establezca la ley, aprueba o rechaza disposiciones legislativas de notoria trascendencia para la vida común en el ámbito estatal o municipal.
El referéndum puede ser total o parcial, según se refiera a toda una ley o solamente a algunos de sus preceptos.
La legislación reglamentaria establecerá las materias que pueden ser objeto de referéndum, los requisitos para convocar y el órgano facultado para hacerlo, así como los plazos para su realización, los procedimientos a que estará sujeto, los porcentajes mínimos de participación electoral y los efectos que produzcan sus resultados.
En ningún caso y por ningún motivo podrá convocarse a referéndum en materia electoral, tributaria o fiscal, los ingresos y gastos del Estado, ni respecto de reformas a la Constitución del Estado o a las leyes locales que se hubieren expedido para adecuar el marco jurídico del Estado a las reformas o adiciones que se hicieren a la Constitución Política de los Estados Unidos Mexicanos.
La Legislatura del Estado convocará a referéndum a petición de:
I. El Gobernador del Estado;
II. El equivalente al treinta y tres por ciento de los Diputados de la Legislatura;
III. El equivalente al treinta y tres por ciento de los Ayuntamientos, que integran el Estado; o
IV. Los ciudadanos, en un número equivalente, al menos, al dos por ciento de los inscritos en la lista nominal de electores en el Estado, en los términos que determine la Ley.
El referéndum se realizará el mismo día de la jornada electoral.
Cuando la participación total en el referéndum sea superior al cuarenta por ciento de los ciudadanos inscritos en la lista nominal de electores en el Estado en el mismo sentido, el resultado será vinculatorio para los poderes Legislativo y Ejecutivo locales y para las autoridades competentes.
